摘要
中国举重运动员刘春红、陈燮霞、曹磊因2016年被国际奥委会和世界反兴奋剂机构复检2008年的样本查出阳性而被取消2008年奥运会比赛成绩与金牌。刘春红与曹磊上诉至国际体育仲裁院,核心的上诉理由为复检规则于2008年时并无规定,所查处的禁用物质并未在2008年的禁用清单上明确列举。这两起案件涉及禁用清单的非穷举式列举、复检规则和时效如何适用、检测结果不一致时如何处理等反兴奋剂领域的根本性问题。2019年11月7日,2021版《世界反兴奋剂条例》刚刚在世界反兴奋剂大会上通过,将于2021年1月1日实施。与目前正在实施的2015版《世界反兴奋剂条例》相比,修改的内容涉及复检规则和样本无限次检测权,对运动员权利有重大影响。结合2021版《世界反兴奋剂条例》的修改内容,梳理刘春红与曹磊案及其他反兴奋剂案件中体现出的规则和趋势,对于把握和了解反兴奋剂领域的国际规则及变化具有重要意义。未来反兴奋剂领域的发展应当兼顾严厉打击兴奋剂与保护运动员合法权利的平衡。
Chinese athletes Liu Chunhong,Chen Xiexia and Cao Lei’s competition results and gold medals were canceled for the Presumptive Adverse Analytical Finding re-analysis of the International Olympic Committee and the World Anti-doping Agency in 2016. Liu Chunhong and Cao Lei appealed to the Court of Arbitration for Sport,the core appeal reasons were the applicable WADA Code did not provide for the re-analysis of samples and the substance GHRP-2 was not listed on the applicable 2008 Prohibited List. These two cases involve non-exhaustive enumeration of banned lists,how re-analysis of samples and timing limited are applicable,and how to deal with inconsistent detection results,and other fundamental issues in the anti-doping field. The 2021 version of the World Anti-doping Code has been just passed by WADA in Nov 8,2019,which will be coming into effect in Jan 1,2021.The new World Antidoping Code covers both the re-analysis and the unlimited testing of the samples involved in the two cases. Analyzing the rules and trends reflected in Liu Chunhong and Cao Lei cases and other anti-doping cases is of great significance for grasping and understanding the international rules and changes in the anti-doping field. Future developments in the anti-doping field should balance the need to crack down on stimulants and protect the legitimate rights of athletes.
