摘要
城郊村的“两委”选举、土地征用与占用、劳动纠纷等法律事务常能引发村民的公共参与,社交新媒体的功能性介入从中起到了信息扩散、人员动员、利益协商、意见整合的功能。上述功能是社交新媒体所打造的“网上家园”功能的延伸。作为“网上家园”的社交新媒体为人们提供了情感寄托、压力纾解以及信息交流的支撑平台。与此同时,以乡土社会的行为模式和价值标准为内容的“村落共识”,也借此平台得以延续,并成为人们在法律事务公共参与当中统一思想、协调行动的观念基础。社交新媒体在城郊村法律事务处置当中的功能与影响,不仅关涉城郊村的社会治理,且将最终投射于整个乡村治理的法治化进程。
Legal affairs,such as the election of Village Party Branch and Committee of the Villagers,the expropriation and occupation of the land and the labor disputes,etc.,could frequently raise the villagers’public participation in the outskirts villages.The new social media plays the role of information diffusion,personnel mobilization,interest consultation and opinion integration by functional intervention in these affairs.The functions above are the extension of“Online Home”produced by new social media.The new social media,as“Online Home”,is the supporting platform for emotional sustenance,spiritual relief and information exchange.Meanwhile,Village Consensus,which includes behavior patterns and value standards of rural society,could be continuous with the support of this platform and become the perception foundation for ideological unity and behavioral coordination in the public participation of legal affairs.The function and inflection of new social media in the management of legal affairs in outskirts villages can not only be related to the social governance in these areas,but also be projected to the whole process of rule of law in rural governance ultimately.
