摘要
随着科技的进步与发展,区块链技术作为一门新技术逐渐走进人们的视野,其技术上的优越性在著作权确权及保护方面有广阔的应用空间,但学界现有关于区块链技术在著作权制度中的运用的论述多停留在技术层面,缺少法学角度的探讨。从权利表征制度出发,区块链技术应用下的著作权登记系统,本质上是一种确权手段,其在知识产权保护中具有重要价值,在对该系统作出价值判断的基础上,对其再进行合法性考察,不难发现区块链技术与现行法并不是完全对立的两面,具有一定兼容性。
With the advancement and development of science and technology,blockchain technology has gradually entered people's field of vision as a new technology.Its technical superiority has broad application space in copyright confirmation and protection,but the academic community has existing blocks.The discussion of the application of chain technology in the copyright system mostly stays at the technical level and lacks the discussion of legal perspective.Starting from the rights representation system,the copyright registration system under the application of blockchain technology is essentially a means of confirming rights.It has important value in the protection of intellectual property rights.On the basis of making value judgments on the system,it is not difficult to find that the blockchain technology and the current law are not completely opposite to each other but have certain compatibility.
