摘要
地方公共行政的实践中,民政部门在社会组织年检中要求其成立功能型党支部的政策,具有党建与行政的双重任务属性。双重任务揭示了党建作为一种规制工具的实现路径,体现了党建的规制功能。然而,在实践中却因其双重任务的特质导致党建规制功能面临着法律依据不充分的障碍,其本质是社会组织功能型党支部的组织法问题。对此可以从法律构造和法律续造两个方面进行完善。建议在国家法律层面制定《社会组织法》,并设置党组织条款。在党内法规层面修改《中国共产党支部工作条例(试行)》第5条,使创新党支部形式多样化。进而使社会组织功能型党支部从国家法律到党内法规到地方性党内规范性文件获得完整的法规范依据。
In the practice of local public administration,the policy of establishing functional Party branch required by the civil affairs department in the annual inspection of social organizations has the dual task attribute of party construction and administration.The dual task reveals the realization path of Party building as a regulatory tool,which embodies the regulatory function of party building.However,in practice,due to the characteristics of its dual tasks,the regulatory function of party building faces the obstacle of insufficient legal basis.Its essence is the organizational law problem of the functional Party branch of social organization.This can be improved from two aspects:legal structure and legal continuation.It is suggested that the law of social organization should be formulated at the level of national law,and the articles of party organization should be set up.At the level of inner-party laws and regulations,article 5 of the regulations of the Communist Party of China on the work of branches(for Trial Implementation)is revised to diversify the forms of innovative party branches.Furthermore,the functional party branch of social organizations can obtain a complete legal basis from national laws,regulations and normative documents within the party.
