摘要
随着信息通信技术与垂直行业的深度融合,新形势下跨行业标准组织共同制定标准成为必然。知识产权对标准组织运作产生深刻影响,所以标准组织需要确保自身知识产权政策的包容性和温和性,还需要明确合作制定标准的知识产权问题的处理机制,以减少后续纠纷的发生。3GPP和IEEE的运作机制进行了对比,分析了知识产权对标准组织运作产生的重要影响。
With deep integration of ICT industry and vertical industy,it is inevitable for both of them to cooperate in standard setting procedure.Intellectual property rights have a profound impact on the operation of standard organizations,and therefore they need to ensure the inclusiveness and moderation of their own intellectual property policies.It is also necessary to clarify the handling mechanism of intellectual property issues,in order to reduce the occurrence of subsequent disputes.This article compares the operation mechanisms of 3GPP and IEEE,and analyzes the important impact of intellectual property rights on the operation of standards organizations.
