摘要
我国《立法法》对中央军委立法权的确认,对于完善具有中国特色的社会主义法律体系、促进军事立法工作发展发挥了重要作用。但军委立法权在实际行使过程中还存在着立法体制不协调、立法权限不清晰、法律法规称谓不规范、军委立法主导作用不到位、立法程序不完善、立法层级不衔接、立法数量与质量不匹配等问题。为了进一步加强与完善中央军委立法权,在坚持中央军委主席签署发布军事法规的基本制度的前提下,必须秉持中央军委"根据宪法和法律制定军事法规"的立法原则,及时修改军事法律、法规原先主管部门的条款规定,健全国务院、中央军委联合立法协调工作机制,明确界定军委及其所属机关和武警部队的立法权限。
The Legislation Law of the P. R. C confirms the legislative authority of the Central Military Commission( CMC),which plays an important role in improving the socialist legal system with Chinese characteristics and promoting the development of military legislation. However,in the actual practice of the legislative authority of CMC,there are still some problems,such as the uncoordinated legislation system,the unclear scope of legislative authority,non-standard titles of laws and regulations,the inadequate leadership of CMC on legislation,the imperfect legislative procedures,the inconsistency of legislative levels,and the mismatch of quantity and quality of regulations. In order to further enhance and improve the legislative authority of CMC,we should uphold the legislative principle of "developing military regulations in accordance with the Constitution and the laws"of CMC,and amend regulations on original competent authorities of military laws and regulations in time. In the same time,we should improve the coordinate working mechanism of joint legislation by the State Council and the Central Military Commission,as well clearly define the scope of legislative authority of CMC with its organs,and the Chinese People’s Armed Police Forces. All activities should be implemented under the premise of insisting the basic system that the Chairman of CMC signs and issues military regulations.
