摘要
文章结合具体实例,指出土地管理工作中存在的一种非理性现象,即轻事实认定、重政策依赖,并分析了其成因及弊端。进而引入拉德布鲁赫相对主义法哲学思想,将土地管理工作结合这一思想法理进行分析,得出结论:土地管理的政策价值,应包含政策本意、土地资源管理要义、社会正义三部分。然后通过数理分析,提出二元策略区别对待理论及无政策依据情形的实体公正办理路径。最后从维护实质正义的社会公平角度,提出营造政策适用创新氛围、建立政策适用容错纠错机制、开通重大损失(害)事项救济通道、提升基层部门制度建设能动性等土地管理“活用”政策的保障举措。
This paper combines concrete examples to point out an irrational phenomenon in land management work, namely, light fact finding, heavy policy dependence, and analysis of its causes and drawbacks. Then it introduces Radbruch's relativistic legal philosophy and analyzes the land management work with this ideological jurisprudence. It is concluded that the policy value of land management should include three parts: policy intention, land resource management and social justice. Then through mathematical analysis, the paper proposes a dual strategy to treat the theory and a non-policy basis for the entity's fair handling path. Finally, from the perspective of social fairness in safeguarding substantive justice, it proposes to protect the policy of applying innovation atmosphere, establishing a policy to apply faulttolerant error correction mechanism, opening up relief channels for major losses (harmful matters), and improving the vitality of grassroots departments and other land management "utilize" safeguard policy initiatives.
