摘要
地方政府规章备案审查制度在维护国家法制统一、维护社会主义法律体系的协调一致、推进法治国家建设、预防并纠正地方政府规章违法失当等方面发挥了十分重要的作用,已经成为我国社会主义法治体系的不可或缺的组成部分。通过回顾地方政府规章备案审查制度产生发展的三个阶段,从行政系统和人大系统两个层面分别以备案和审查的视角对这一制度进行现实考察,并就这一制度的发展趋势进行了展望,以期为该制度的发展提供历史借鉴。
The local government regulations review system has played a very important role in safeguarding the unity of the country 's legal system, maintaining the coordination of the socialist legal system, promoting the construction of the country ruled by law, preventing and correcting the violation and misconduct of local government regulations. It has become an indispensable part of China's socialist rule of law system. This paper reviews the three stages of the development of the local government regulation review system. From the two levels of the administrative system and the NPC system, we can have a realistic investigation of this system and conclude the tendency to provide a historical reference for the development of the system.
