摘要
专家辅助人制度对医疗诉讼的解决具有重要意义。但因为法律规定的不够完善,在实际运用中存在专家辅助人参与医疗诉讼范围狭窄、参与程序模糊、权利义务不完善等问题。通过对国外相关制度的学习和借鉴,试图为我国医疗诉讼专家辅助人制度的完善提出合理建议。
The system of expert assessor is of great significance for the judicial settlement of medical damage liability disputes in civil litigation. But because of the imperfection of the law,in practice,there are problems,such that expert assessor has narrow participation of medical litigation, participation procedures are ambiguous, and rights and obliga. tions are imperfected. By trying to explore the extraterritorial related systems,suggestions are put forward to improve the expert assessor system in China’s medical litigation.
