摘要
一般意义上的行政解释包括抽象行政解释和具体行政解释。我国的行政解释仅承认抽象行政解释的存在,将行政解释视为一项单独的权力,为一定级别的行政机关所保留。现行的主要依靠人大监督和行政内部监督来制约行政解释权的模式没有产生理想的效果,导致实践中存在诸如滥设行政解释主体、行政解释对司法权的强压迫性、行政解释突破上位法边界等行政解释权滥用的问题。未来我国行政解释制度的完善,应以规范行政解释权为出发点,在继续加强和完善立法监督和行政内部监督的同时,确立司法审查作为行政解释的控权支柱——在理论上为具体行政解释正名,以使其接受司法审查的约束;确立抽象行政解释的司法最终裁决原则以及逐步建立平衡司法审查与行政解释的具体审查立场与标准。
Administrative interpretation in the general sense includes abstract and specific administrative interpretation.While only abstract administrative interpretation is admitted in China,which is regarded as a separate power and hold by administrative organs at a certain level.As the existing mode which mainly relies on the supervision of the National People's Congress and the internal supervision of the administrative system to restrict the power of administrative interpretation has not produced the desired effect,the abuses of administrative interpretation such as illegally setting subjects of administrative interpretation,oppressing the judicial power and breaking through the boundary of higher rules exist in practice.In the future,China's administrative interpretation system should be improved on basis of the regulation of administrative interpretation power,and through establishing judicial review as the control pillar of administrative interpretation at the same time of continuing to strengthen and improve legislative supervision and internal administrative supervision,namely,the specific administrative interpretation should be clarified in theory to make it be subject to judicial review;through establishing the principle of judicial final ruling on abstract administrative interpretation to gradually set forth the specific review position and standards for balancing judicial review and administrative interpretation.
