摘要
随着全面深化改革的持续推进,授权暂停法律实施制度在我国得到广泛应用,目前已涉及43部法律和五大领域,成为完善中国特色社会主义法律体系与保障改革顺利推进的重要制度探索。该制度在法律性质上既不属于法律修改,也不属于授权立法,而是一项独立的立法权行使形式。由全国人大通过的《立法法》第13条是对宪法第67条第21项规定的具体化与落实,为授权暂停法律实施提供了合宪性基础。然而,该制度的发展态势随时可能打破其合宪性状态,需要进行合宪性控制。具体来说,应当对《立法法》第13条进行法律解释,并建立相应的配套制度以加强对全国人大及其常委会授权暂停法律实施的监督,将暂停法律实施制度纳入法治轨道。
With the continuous deepening of the reform,the institution of authorizing the law to suspend implementation has been widely applied in our country.At present,it has covered43laws in5major areas and has become an important part of perfecting the legal system of socialism with Chinese characteristics and ensuring the smooth progress of the reform.The legal nature of this institution is not law amendment,nor is it an authorized legislation,but an independent form of exercise of legislative power.Article13of the Legislation Law amended by the NPC is the concretization and implementation of article67,item21of the Constitution,providing a constitutional basis for the suspension of law implementation.However,the development trend ofthe institution could break its constitutionality at any time and requires constitutional control.Specifically,it isdesirable to make a legal interpretation of article13of the Legislation Law,and establish supporting institutions so as to strengthen the supervision over the power of the NPC and its standing committee in suspension law implementation to put the power into the legal track.
