摘要
法家"刻薄寡恩"的评价并非是后世儒者的攻讦,实为时势环境所认同,是针对法家治国理论中宣扬君主专制,主张人性自利,倡导严刑峻法等一系列反现代法治精神的客观评价。"刻薄寡恩"体现出的并非是法文化底蕴,实为"伪法文化";"刻薄寡恩"并未赋予法家治理理论现代性,法家治理理论也并未有现代性可言。弘扬优秀传统文化固然是时代要求,但一定要警惕法家文化的"伪现代性"。
The evaluation of the lawmakers“ruthlessness”is not the criticism of the later Confucian scholars.It is identified by current situation.“Ruthlessness”is objective evaluation of the law theory about the monarchy,advocating human nature,advocating strict laws and a series of anti modern law spirit.“Ruthlessness”does not reflect the cultural heritage of the law,and it is“pseudo law culture”.“Ruthlessness”does not provide the theory of legalists for modernity.Legal theory of governance is also not modernity at all.It is the requirement for the times to carry forward the traditional culture,but it must be vigilant against the“pseudo modernity”of legalist culture.
