摘要
当前,腐败资产转移境外现象相当突出,已成为新时期腐败犯罪发展变化的一个新动向,也是我国刑事司法面临的一大难题。加强反腐境外追赃工作,是我国反腐败工作的重要内容,也是新形势下深入开展反腐败斗争的现实需要。《联合国反腐败公约》确立的资产追回机制,为腐败资产追回国际合作提供了坚实而宽广的法律基础,具有标志性的意义。我国积极建立健全腐败资产追回机制,综合运用直接追回、间接追回等多种途径,追回了大量腐败资产,形成了多元化的境外追赃体系。做好新形势下的反腐境外追赃工作,应实现追赃与追逃并重,完善"违法所得的没收程序",确立承认、执行外国刑事罚没裁决的制度,建立务实合理的资产分享机制,探索组建一支境外追赃专门队伍。
Nowadays,China’s transfer of corruption assets abroad is very serious,which has become a newtendency of corruption and a big challenge to China’s criminal justice system.It is not only an important partof China’s anti-corruption work,but also a realistic need for deepening anti-corruption struggle under the newsituation.The mechanism of asset recovery established by The United Nations Convention against Corruptionprovides a solid and spacious legal basis for international cooperation on asset recovery,which has a symbolicmeaning.China has achieved remarkable effects by use of direct and indirect way of asset recovery,andformed a diversified system of asset recovery.In order to improve China’s mechanism of booty recovery fromforeign countries,we should pay attention to hunting for those who have fled abroad and recovering illegalassets.Moreover,we should perfect“the confiscation procedures of illegal assets from corruption”,establishthe system of admitting and enforcing foreign criminal confiscation,set up practical and rationalassets-sharing mechanism,and build a special team of recovering illegal assets as well.
