摘要
实践合理性,意即依据一种普遍的、科学而有效的理性和价值标准对制度运作实践及其结果的反思、评价和规范。在实践哲学思维方式的指引下,以反思性研究方式探讨司法实践合理性问题,其目的就是要追问并评价司法实践目的的正确性、正当性、合理性,从而在反馈和修正的基础上实现司法制度运作实践过程和手段的科学性、最优化。通过理论体系的构建和操作程序的细化,对司法运行过程和效果进行跟踪、监督、评价和反馈,以期促进对司法制度运作细节和技术结构的深入理解,推进司法制度的良性进化和科学发展。
On the rationality of practice,the purpose of exploring the rationalization of rational judicial practice from the perspective of philosophical thinking in practice under the guidance of the reflective research,is to seek the correctness,validity and rationality of the judicial system,to contribute to the optimized and scientific approach to the operation of the judicial system. By refining the construction and operation procedure of evaluation theoretical system of the judicial system,it is possible to track,supervise and evaluate the judicial system operation process,so that to improve a better understanding of the judicial system and the operation details of technical structure,and promote a benign evolution and scientific development of the construction of judicial system.
