卓越法律人才导向下模拟法庭教学的理性安排 被引量:4

The Rational Arrangement of Moot Court Teaching under the Guidance of the Outstanding Legal Talent

摘要 模拟法庭教学源起于英国。我国模拟法庭教学呈现了重视理论知识而轻视实践技能、重视程序内容而轻视实体内容、重视刑事诉讼而轻视民行诉讼、重视一审程序而轻视其他程序、重视形式而轻视实战的弊端,制约与阻碍了模拟法庭教学价值的发挥。在厘清当前我国法学教育理念的基础上坚持法学教育的实践面向,单独设立模拟法庭课,规范模拟法庭教学的指导制度、运行制度、评价制度,建立校外模拟法庭教学基地,给予模拟法庭教学充分的物质保障,利用模拟法庭软件开展网络教学,理性重构模拟法庭教学,培养法律职业共同体,化解法学智能教育与技能教育的抵牾。 The moot court teaching originates from the United Kingdom. There are many ills of our moot court teaching. For example,we attach importance to the theoretical knowledge and contempt practice skills; we attach importance to the application content and despise entity content; we attach importance to the criminal procedure and despise the civil procedure and the administrative procedure; we attach importance to the first trial procedure and despise the other procedures; we attach importance to the form and despise the practical experience. These many ills hinder the development of our moot court teaching. So we should clarify the current legal education ideas of our country and persevere in the legal practice education. And we should set up the specification of moot court teaching,and standardize the moot court teaching in the guidance systems,the running systems and the evaluation systems. We should set up the outside the college of the moot court teaching base,and ensure the sufficient material. We should use the software simulation court to carry out network teaching. We rationally reconstruct the moot court teaching,in order to cultivate the legal professional community and dissolve the contradiction between the intelligence education and skills education in the legal education.
