摘要
近年来,独狼式恐怖主义活动越来越多的进入了人们的视野,作为一种主体独立、选择自由,危害更大的恐袭手段,俨然成为国家安全的最大威胁。伴随着个体型恐怖主义犯罪新特征的出现,俄罗斯、英国、德国等国家纷纷通过颁布新的法案或修改刑法典来对此类犯罪进行有效的防控和打击。虽然我国立法机构根据当前惩治恐怖犯罪活动的实践需要,在2015年先后通过了《刑法修正案(9)》和《反恐怖主义法》,但针对独狼恐怖主义犯罪在刑法规制上仍存在欠缺和不足,需要进一步完善。
In recent years, more and more Lone-Wolf terrorist activities have entered people＇s field of vision. As an terrorist means of independent subject, freedom of choice, and more harm, it has become the greatest threat to the national security. With the emergence of new features of individual terrorism crimes, Russia, Britain, Germany and other countries have enacted new laws or mod- ified the criminal code to effectively prevent and combat such crimes. According to the current practice of punishing terrorist crimes need, the legislature in China has passed the Ninth Amendment to the Criminal Law of the People＇s Republic of China and the Anti-ter- rorism Action 2015. But here are still some deficiencies in the criminal law regulation for the crime of Lone-Wolf terrorism and some deficiencies need to be further improved.
