摘要
随着标准必要专利发展的发展,衍生出的FRAND劫持对市场健康运转造成巨大阻碍。针对FRAND劫持的定义、表现形式、产生原因,以及运用法律规制FRAND劫持等技术标准化中的关键问题,采用文献研究法、案例研究法、比较分析法等进行阐述。分析指出,FRAND劫持是专利实施者在标准必要专利中,通过拖延谈判、拒绝协商或以起诉威胁等方式,利用FRAND原则、禁令限制等反向劫持专利权人,以获得更低廉专利许可费或免费使用专利的行为;FRAND劫持作为专利标准化过程中的新生景象,具体形式表现为提起诉讼的积极手段与拒绝、拖延谈判的消极态度;引起FRAND劫持的原因多样,包括当事人谈判地位不平等、FRAND原则的不确定性、标准制定组织的态度以及禁令通过率大幅度降低。因此,我国必须坚持诚实信用原则、重视禁令的使用,并建立事前披露和公开专利使用费机制,才能使专利法促进创新的宗旨实至名归。
With the development of society and the innovation of the production,SEP becomes a symbol of developed science and technology.FRAND holdup which is derived from SEP has roused huge troubles to the function of market.This research uses literature study,case study,comparative study to illustrate what FRAND holdup is,what ways it shows in and why it appears,and how legal system controls patent holdup.FRAND holdup means that patent users delay and refuse negotiation,or threaten patent holders with prosecuting in SEPs,taking advantage of FRAND commitment and injunction limit for lower patent fees,even for free use.As new things in patent standardization,it shows positive phenomenon such as suing patentees and negative one like delaying or refusing negotiation.There are many factors to produce FRAND holdup,including two parties at unequally positions,uncertain FRAND commitment,and the attitude of standard organizations and decrease of injunction.It is necessary for China to obey good faith principle,value injunction and set up prior information and patent fees disclosure system,only in these ways,the purpose of promoting innovation can be achieved.
