摘要
[目的/意义]专利引用是专利价值评价的指标之一,深入分析施引专利与原专利之间的关系,可以有效地评判专利引用指标在专利价值评价中的效力。[方法/过程]首先,选取获得中国专利奖,且在美国提交申请的专利,再检索获奖专利的施引专利,通过对比施引专利与获奖专利的摘要和权利要求等,可将施引专利分为差异技术、关联技术、同类技术和近似技术4类。其次,对这4类施引专利做统计上的比较以及检验。[结论/结果]研究表明,专利引用可以有效作为专利价值的评价指标,且专利引用可作为遴选专利的指标。不同施引专利的类型在专利价值评价中的效力不同,只有将施引专利进行分类处理,才能更好地将专利引用指标应用于专利价值评价。
[ Purpose/Significance ] Patent citation is one of the indicators of patent value evaluation, the detailed analysis of the relationship between the Citing Patent and the original patent can effectively judge the effectiveness of patent citation indicator in the patent value evaluation. [ Method/Process ] Firstly, we chose the Chinese awards patents which had filed the patents application in the United States, and then retrieved citing patents of the awards patents, by comparing abstract and claims of citing patents with awards patents. Citing pa- tents could be divided into such four categories as discrepancy technology, related technology, similar technology and approximation tech- nology. Secondly, we compared and tested the four categories of citing patents. [ Result/Conclusion] Research shows that patent citation can be found effectively as an evaluation index of patent value evaluation and also can be an indicator selecting patent. Different types of citing Patent have different effectiveness on patent value evaluation, only classifying citing patents can better apply the patent cited indicators to patent value evaluation.
