摘要
在严重的土壤污染和大规模的土地再开发背景之下,如何以立法预防和修复污染是我国面临的重大课题。在相似的历史背景下发展起来的荷兰土壤污染法律责任及资金保障机制可为我国的制度建设提供借鉴。基于历史沿革和法律属性差异的原因,荷兰对土壤污染导致的三种法律责任(即传统人身、财产损害的民事责任、修复费用的赔偿责任及修复责任)采用了分割构造的模式。本文分别介绍了这三种责任及其资金保障机制,并运用法经济学的方法分析了这些制度在预防和修复污染方面的作用。最后,文章结合荷兰经验和我国国情进分析,以期为我国的制度设计提供有效的建议。
How to ensure the prevention and remediation of soil pollution via legislation is a big challenge under the con- text of serious pollution and the large scale of land redevelopment. The Dutch liability rules for contaminated land and financial security mechanisms which were developed under similar context provide an important lesson for China. Due to historical rea- sons and different legal features, the Netherlands has established three types of liability rules for soil pollution: the civil liabib ity for traditional damage, the civil liability for the remediation costs and the public liability for remediation itself. This article introduces these three types of liability respectively and analyzes the popularly used financial security mechanisms for the liabil- ity. Economic analysis is used to evaluate to which extent the rules have been helpful in achieving the goal of prevention and re- mediation. In the last part, this article examines to which extent the Dutch experience could be transferred to China.
