摘要
在国内公共体育场馆市场化改革进程中,面对"市场失灵"+"政府失灵"双重困境,运用逻辑分析等研究方法,对动态社会契约论中多元社会结构的合法性与合理性进行分析,提出公共体育场馆服务外包监管的应然逻辑,即从单一主体发展为多元主体。运用交易成本、执行成本、信息成本、诉讼成本、制度均衡成本等经济指标参数对政府主体监管、社会中间层主体监管和市场主体监管3种公共体育场馆服务外包监管模式进行实然分析,明确每种监管模式的优势与劣势。挖掘场馆服务外包多元监管模式的深层内涵,归结出契约化管理是该监管模式的关键所在。构建基于契约过程的公共体育场馆服务外包多元监管模式的实践体系:政府作为契约监管的主导力量,应全程参与各环节监管工作;社会中间层应充分发挥契约监管的主体作用,强化自身社会舆论引导与具体业务管理功能;积极培养消费者监管意识,在场馆外包契约执行以及契约绩效评价过程中能够理性吸纳民众意见,使消费者群体成为契约监管的基础力量。
Along with the process of the market-oriented reform of public sports stadiums,in face of ＂ market failure＂ ＋ ＂government failure＂ double dilemmas,this paper puts forward supervision logic of the public sports stadiums from a single subject to multiple subjects based on the dynamic society contract theory about the multi-element of social structure.We analyze the government＇s main body supervision pattern,the social middle layer of the main body supervision pattern and the market＇s main body supervision pattern in the actual conditions and further clarify the strengths and weaknesses of above supervision modes by the use of these economical index parameter including transaction cost,implement cost,information cost,and lawsuit cost,institutional equilibrium cost etc.Based on excavating the connotation of multi-supervision pattern of stadium service outsourcing,the key to this supervision mode can be formulated as a contractual management problem.This paper constructs the practice system of multisubjects supervision mode of stadiums service outsourcing based on contract process.The government should participate in the whole processes of contractual supervision as a leading force.It is necessary that the social middle layer exert subjective role to guide public opinions and control business.It is also important to make consumers become the basic force of contractual supervision through cultivating consumer supervision consciousness and adopting their suggestions.
