摘要
学界与实务界对著作权纠纷中如何确定侵权复制品销售者的赔偿责任,一直以来争论不断。实际上《著作权法》第53条中"发行"只是对销售复制品上游环节的规定,对下游环节的"销售"并没有作出规定,这是导致法律适用混乱的根源。基于侵权复制品销售者的"销售"行为系下游环节,因此不能对其课以严格的注意义务,而只能是有限的注意义务。在具体案件的处理中不能直接适用《著作权法》第53条,而只能进行类推适用。
There have been constant arguments in the educational and professional circles over how to determine the liability for damages of sellers of tort replicas in copyright disputes. In fact, the provisions governing the "distribution" in Article 53 of the "Copyright Law" are merely concerned about the upstream links of replicas, and there is no relevant provisions governing the "sale" in downstream links, which is the main cause for the confusing application of law. In that the act of "sale" of the sellers of tort replicas falls into the downstream links, no strict duty of care can be required therefor other than limited duty of care. In concrete cases, the application by analogy shall be adopted instead of the direct application of Article 53 of the "Copyright Law".
