摘要
行政解释权的规范渊源包括但不限于1981年《关于加强法律解释工作的决议》,法规、规章、单行条例中的解释权条款也是行政解释权的法律依据。行政解释权的规范渊源过于庞杂,缺乏高效力层级法律规范的统一规定;部分地方性法规与1981年《决议》关于省级政府是否具有省级地方性法规解释权的规定不一致,有损法制的统一性;1981年《决议》未涉及行政法规、市级地方性法规、单行条例及规章的解释权问题,前述法律规范仅部分设置了解释权条款,部分未作明确规定,其行政解释权的法律依据缺失;实践中存在依照无效内部规范性文件行使行政解释权等问题。我国应制定《行政解释条例》,并通过法院在行政诉讼中对行政解释行使合法性判断权和选择适用权,保障行政解释权在法律的框架内运行。
The origin of the norms for the power of administrative interpretation includes without limitation the Resolution of 1981.The terms about interpretation power in laws,regulations,rules and separate regulations also constitute the legal basis of administrative interpretation power.This origin,which is too enormous and jumbled,lacks the uniform provisions of the legal norms at a level of highly efficiency.Some local regulationsare inconsistent with the Resolution of1981 in the provisions on whether a provincial- level government has the power to interpret provincial-level local regulations,which impairs the uniformity of the legal system.The Resolution of 1981 does not involve the interpretation power of administrative regulations,city-level local regulations,separate regulations and rules.Only part of the above legal norms contain provisions on interpretation power,while the rest of them has no express provisions and lack the legal basis for administrative interpretation power.In practice,there exists the problem of exercising administrative interpretation power on the basis of invalid internal normative documents.It is suggested that the Regulations on Administrative Interpretation should be formulated and that the legality judgment right and selective application right should be exercises for administrative interpretation through courts in administrative lawsuits to ensure that the administrative interpretation power will operate within the framework of laws.
