论海上共同开发区的法律适用问题被引量：3

摘要海上共同开发区法律适用的情形主要涉及争议海域海上共同开发区的法律适用和跨界海上共同开发区的法律适用。综合1958年以来海上共同开发的国际实践,海上共同开发区的法律适用主要有分别适用、共同适用和综合适用三种类型。海上共同开发区适用的法律主要有国际法、国际石油开发合同、特别法和国内法。今后我国应选择有利于维护中国国家利益的海上共同开发法律适用模式。
