摘要
党的十八届四中全会将十五大提出的依法治国基本方略提升到一个全新的境界。依法治国,必须具有完备和良好的法律制度。党的十八届四中全会提出要加快建立"生态文明法律制度",强调"必须弘扬社会主义法治精神"。生态文明法律制度与社会主义法治精神相辅相成、互为表里。生态文明法律制度在制度层面是生态文明建设法制化与法律制度体系生态化的有机统一;在精神层面是社会主义法治精神与生态文明理念的有机统一。建立健全生态文明法律制度,并使其成为生态文明建设的根本保障,不仅要充分体现和弘扬社会主义法治精神,而且要把生态文明的理念融入法律制度建设中。
The Fourth Plenary Session of the Eighteenth Central Committee of CPC ascend the basic approach of ruling the country by law to a new realm. To rule the country by law,we must have a well established law system. The Plenary Session puts forward to speed up establishing the ＂ legal system of ecological civilization＂ and stress ＂ to carry forward the spirit of socialism rule of law necessarily＂. The legal system of ecological civilization and the spirit of socialism rule of law are indispensable to each other. The legal system of ecological civilization is the organic unification of ecological civilization construction and ecological legal system at the system level. Also,it is the organic unification of spirit of socialism rule of law and ecological civilization concept on the spiritual plane. To establish and perfect the legal system of ecological civilization and make it to be the fundamental guarantee of the construction of ecological civilization,we should not only fully embody and carry forward the spirit of socialist rule of law but also integrate the ecological civilization concept into the construction of the legal system.
