摘要
在中世纪的欧洲,法律发展的基本背景是教俗两界争夺人间秩序的最终统治权,即"两剑之争",各类世俗法一方面抵抗教会法,另一方面又不得不"模仿"教会法,这构成了中世纪法律丛林中独特的多元风景。本文主要从日耳曼法的封建化开始,探讨中世纪存在着的一种被后世称为"封建法"(feudal law)的法律体系,包括其来源与变迁、基本内容与特征及其在中世纪诸法律体系中的地位,并且延伸论证"封建"这个概念的学术史变迁。
Which is the supreme authority in Middle Ages? The sacred authority or the royal power? This is a problem. "The Doctrine of Two Swords" -- the theory of struggle between spiritual sword and secular sword -- shows the basic context of evolution of laws in medieval Europe. On the one hand, These secular laws countered to the canon law, but on the other hand, they had to follow the can- on law. This articleintroduces and analyzes the system of "feudal law" in medieval Europe which was named by posterity. The system of feudal law derived from the feudalization of Germanic law was a structured system which was borrowed from the method of systematization of canon law as well as other secular legal systems. This article also gives a clear explanation of the origin and transition of the feudal law and recapitulates the principal elements, the fundamental characteristics and the status of this legal system. In order to understand the conception of " feudal/feudalism", this article differentiates the three meanings of the word, especially in the history of the academic ideas.
