摘要
临时工问题舆情化,使之被赋予不应有的负面意义和敏感性。临时工一度是个"正式"概念,后来被排除在规范的法律话语体系之外,却"勃兴"于现实的土壤。究其原因,劳动关系正处于单位型向市场型转变过程中,劳动者主体地位的建立也经历了从身份到契约的变化。公共部门劳动关系也因应时势,策略性选择非典型用工,但进程阻滞,三方协商机制失灵,排斥、侵权与推责等负面效应滋生。临时工问题已成为复杂的社会问题,应置于机构改革,落实相关制度,推进市场型劳动关系规范化,在保障劳动权利和体面劳动的系统进程中去解决。
Temporary worker was once a "formal"concept,then was excluded from legal discourse system specification,but"prosperity"in the soil of reality. It was only because that labor relations in China are transiting from the "unit type"into the"market type,"the subjective status of laborers is changing from"identity"into"contract"status. In accordance to the current situation,the labor relations in public sector made strategic choice of atypical employment,but it caused negative effects,such as failure tripartite mechanism,exclusion,tort and prevarication. The problem of temporary workers has become a complex social problem. It should be placed in the institutional reform,to imp0 lement the relevant regulation,to promote the legal labor relations and decent work,so as to resolve the problem.
