摘要
研究目的:通过对宅基地使用权立法历程进行溯源性研究,以及国外相关立法例比较研究,厘清宅基地使用权发展路径,结合现实需要,对宅基地使用权未来塑造指明方向。研究方法:系统分析法、比较分析法。研究结果:对宅基地使用权进行空间权塑造实有必要,这将十分有利于中国的城镇化进程,是破解宅基地使用权"流转"谜题和释放大量农村建设用地存量资产的钥匙。研究结论:应结合社会现实和立法发展方向,进行宅基地使用权空间权塑造。
The purpose of this paper is to clarify the legislative development path of the use right of rural residential lands and point out the future legislation direction by systematical research on the related legislative history and comparative research on the relevant foreign legislation. Methods used include systematical analysis and comparative analysis. The results indicate that it is necessary to model the use right of rural residential lands as space right. By achieving this, it would significantly facilitate the process of urbanization in China. It is also crucial in solving the puzzle of the circulation of the use right of rural residential lands, consequently providing a golden key to releasing a lot of assets of the rural construction lands in stock. The paper concludes that we should take into consideration the social reality and legislation development direction, and model the rural residential land use right as space right.
