摘要
出于准确性的要求,形式主义裁判伦理已经无法适应裁判员身份认同、权威界定以及执法理念的新要求。从后果主义伦理对裁判身份认同的影响以及后果主义伦理倾向对执法目的和标准的影响两方面,论述了后果主义裁判职业伦理的合理性,并主张在此基础上重新解释裁判权威和自由裁量,从而在一定程度上消解了形式主义的裁判至上原则同裁判准确性之间的矛盾,为规则的改良与完善提供了依据。
In order to improve the accuracy o~ referee＇s judgment, formalist referee theories can not meet the new requirement of referee identity, authoritative definition and concept of regulation enforcement. This paper demonstrates the rationality of professional ethics of referees in terms of consequentialist ethnics＇ influence to referee identity and consequentialist ethnics tendency＇s influence to the purposes and standards of regulation enforcement, and on this basis, it advocates to re-explain the referees＇ authoritativeness and discretion. To certain extent, this can eliminate the conflicts between the formalist principle of supreme referee and the accuracy of referee＇s judgment, in a bid to provide a basis for modification and improvement of football rules.
