摘要
在我国农村土地产权归集体所有的法律架构下,家庭承包经营权成为亿万农户家庭对集体土地所享有的一项至关重要的财产权利。土地承包经营权流转为其财产权利的实现提供了现实条件,然而抵押作为流转的一种方式尚未得到法律确认,无疑限制了其财产属性的实现和土地流转的活力。本文对家庭土地承包经营权抵押内涵、抵押的可行性和设置抵押的障碍进行了分析,提出了建立和完善家庭土地承包经营权抵押的相关建议。
In the legal framework that rural land property right is owned by the collective, household contract operation right has be-come an important property right for millions of farmers to share collective land. The land circulation provides realistic conditions for the realization of property right. But the mortgage, as a way of transfer, has not been confirmed by law, which limits the implementation of its property attribute and vitality of land transfer. This paper analyzes the connotation, feasibility and obstacles of the mortgage of household contract management right, and proposes relevant recommendations on the establishment and improvement of the mortgage of household contract management right.
