摘要
网络时代下,一方面,国家主权受到了一定程度的挑战;另一方面,国家主权理论也在应对挑战的过程中获得了继续发展的机会。网络主权是国家主权在网络空间的延伸,即一国独立自主不受他国干涉地进行网络空间活动、处理网络空间事务并对网络攻击行为实施自卫的权利。网络主权是国家主权的下位概念,网络主权的相对性、国际性更加明显。网络主权是国家主权的最新发展和重要组成部分,网络时代国家主权的有效行使和维护离不开网络主权,网络主权与国家主权相辅相成,互为支撑。
In the Internet age, national sovereignty is challenged to a certain degree; however, national sovereignty theory, faced with the challenges, has gained opportunities to develop. Network sovereignty is the extension of national sovereignty in cyberspace. It means that a state has the fight to carry out activities and deal with events in cyberspace, and the right of self-defense against network attacks, Network sovereignty is a subordinate concept of national sovereignty, with obvious relativity and internationality. Network sovereignty is the latest development and an important part of the national sovereignty. The effective exercise and malntatntng of national sovereignty is Inseparable from the network sovereignty. So the network sovereignty and national sovereignty are complementary and mutually supportive.
