摘要
版权制度的产生、发展与技术变革具有密切关联,技术变革既推动了版权制度的发展与完善,也给其带来严峻挑战。云计算技术下作品传播利用的新特点使版权制度陷入困境。作为一种路径选择,替代版权模式难以落地生根,版权制度的未来方向应在现有法律框架内,通过调整版权专有权利、合理界定公有领域、引入反垄断条款,实现版权制度的平滑过渡,当然,替代版权模式可减少法律运行成本,促进未来版权制度的优化。
The generation and development of copyright system are closely related to technological change. Technological change has not only promoted the development and improvement of the copyright system, but also brought the serious challenge. The new characteristics of propagation and using made the copyright system in trouble under cloud computing technology. As a choice, to give up the current copyright mode is impossible. The future direction of the copyright system should be within the existing legal framework, by adjusting the copyright proprietary rights, reasonable definition of the public domain, introducing of antitrust terms, which can realize the smooth transition of the copyright, of course, the alternative copyright can reduce legal running cost and promote the copyright system optimization in the future.
