摘要
在行政执法与刑事司法衔接机制建立的过程中,由于检察机关行使监督权的措施规定得不明确具体,缺少灵活性、强制性,无法对行政执法机关在向刑事司法机关移送案件时出现的发现多、移送少的情况进行有效监督。这严重影响对经济犯罪的打击力度,同时,也给行政执法人员在执法过程中滥用职权留下了空间。因此,加强对行政执法的法律监督,完善立法,赋予检察机关对行政执法监督的提前介入权、行政执法监督调查权、督促执法权、行政违法纠正权成为解决这一问题的有效途径。
In the process of establishing the emergence mechanism of administrative law enforcement and criminal justice, the procuratorate can not effectively supervise criminal law enforcers' work owing to the unclear and unspecific stipulation about the procuratorate's supervision measures, and lack in flexibility and forcefulness. This situation seriously influences it to crack down on economic crimes, and simultaneously leaves room for law enforcers' irresponsible enforcement. Therefore, it becomes an effective solution to this problem to put administrative enforcement under strengthened supervision, improve legislation, entrust the procuratorate with early intervention rights, the investigation rights, urging rights, and correction rights of administrative violations, in the supervision of administrative enforcement.
