军民融合背景下构建国防专利处置权之探讨 被引量:4

Discussion on Constructing National Defense Patent Disposal Right under the Background of Civil-military Integration

摘要 军民融合作为国家战略,它是经济建设与国防建设发展由分到合、由浅至深、由点及面的有机融入过程,在军民融合发展的大背景下,作为国防知识产权最为重要的组成部分的国防专利权及其相关权利成为关注的重点,尤其是为了促进军民融合发展,必须解决国防领域专利技术成果转移转化问题,构建国防专利处置权是解决该问题的关键。构建国防专利处置权须严格限定国防专利的范围并进行分类指导,明确国防专利处置权的权利主体,明晰国防专利处置权权能,确立国防专利处置权限制性处分的分类监管机制。以此构建国防专利处置权规范体系。 As a national strategy,military and civilian integration is an organic integration process of economic construction and the construction and development of national defense from division to integration,from shallow to deep and from point to surface. In the context of the development of civil-military integration,the national defense patent and its related rights,as the most important component of the intellectual property rights of national defense,have become the focus of attention. Especially,in order to promote the development of civil-military integration,it is necessary to solve the problem of transfer and transformation of patented technological achievements in the field of national defense,where the key solution is to construct the disposal right of national defense patents.To construct the disposal rights of national defense patents must strictly limit the scope of national defense patents and conduct classified guidance,specifying the right subjects,clarifying the powers and functionsof therights,and establishing a classification and supervision mechanism for restrictive sanction of the rights. In this way,we can build a standard system of the disposal rights of national defense patents.
