摘要
农地规模经营是农业现代化的主要途径和重要手段。农地规模经营法律规制的本质在于强调政府的"适度"规制行为,具有维护土地的公共利益目标,矫正农地规模经营过程中的市场失灵,消除农地规模经营负外部性的正当性。针对当前农地流转与规模经营法律制度的滞后性、法律体系不健全、农地保护法律制度价值错位等问题,以农地规模经营法律制度构建为逻辑起点,提出我国农地规模经营法律制度构建的路径。
The large-scale operation of agricultural land was the main way and important means for agricultural modernization.The essence of the legal regulation of the large-scale operation of agricultural land lay in emphasizing the"moderate"regulation behavior of the government.It had the goal of safeguarding the public interest of land,rectifying the market failure in the process of farmland scale operation and eliminating the negative externality of farmland scale operation.The legal system of the current land transfer and scale management was lagging behind,the legal system was not sound,value of the land protection legal system was displaced,et al.Taking the legal system design of agricultural land scale management as the logical starting point,by setting up land circulation system and adding incentive regulation system,the system design of scale management of agricultural land in China was put forward,and the development of agricultural modernization was promoted.
