摘要
婚约是一种身份契约，其存在具有历史和现实的基础。目前，我国法律对于婚约问题采取的“不提倡，不禁止，不规范”的回避态度实不可取。婚姻家庭法应继承古代婚约制度之精华，吸收外国婚约立法之理念，对婚的进行立法规范。
Engagement is a contract of people's relationship. It has the historical and actual base. At present, to-wards engagement, the legislature body takes attitude of no advocating , no prohibiting and no regulating. We should take the experience of old engagement system and draw lessons from foreign legislation of engagement. Then, we should legislate the engagement.
