摘要
Internet与国际私法有着天然的密切联系。作者在具体分析跨国侵权、知识产权和电子商务等三个常见的网上法律冲突的基础上 ,从国际私法的视角解析了两种不同的网上法律关系 :与Inter net有关的法律关系和Internet法律关系 ,并详细探讨了Internet对于连接点、法律选择方法、准据法、管辖权、国外送达和取证等国际私法问题的挑战 ,探讨了一些应对策略 。
The INTERNET has an intrinsic relationship with international private laws. On the basis of concrete analyses of legal conflicts that frequently occur on the INTERNET with regard to international tort, intellectual property rights and E commerce, the authors focus on legal relationships on the INTERNET and discuss the challenges of the INTERNET to international private laws in terms of related laws, the methodology of the choice of laws, applicable laws, jurisdiction, service and taking evidence abroad. The authors put forward their own views on the solution to these challenges and review the opinions of foreign scholars.
