摘要
当今中国高等教育市场化日益明显,高校人才流动中各主体之间也存在着各种利益分歧,归根结底是对人力资本的权属争议。唯有依法明确各自的法律地位及其相互关系,并通过法律解释方法适当扩大约定服务期、竞业限制、反不正当竞争等法律制度的适用范围,方能规范目前我国高校人才流动中的失范行为、平衡各方合法权益。
Currently the Chinese higher education is getting obviously more marketized and a difference in interests exists between principals in the university talent flow, which attributes to the dispute of human capital. The solution to normalize the present deviated behavior of the university talent flow and balancing the legal rights of related parties is to clearly define respective legal status and correlation according to the law, and to properly enlarge the application range of legal system like service period, noncompetition and anti-unfair competition law, etc.
