国际商事仲裁市场竞争机制下国内法院对国际商事仲裁的支持被引量：8

摘要国内论者对国际商事仲裁司法审查问题的研究基本局限于法学的视野,关注焦点在于如何以司法审查维护仲裁的公正与效率。本文则主要以经济学的视野,以新近国际上兴起的国际商事仲裁市场竞争观念为指引,从增强本国仲裁国际竞争力的角度对国际商事仲裁司法审查问题作了全新研究。首先,对"国际商事仲裁市场"做了必要解构,分析了国际商事仲裁市场竞争的基本机制,论证了一国的仲裁司法审查实践是影响该国仲裁在国际商事仲裁市场上竞争力的重要因素之一;其次,以比较的方法研究了国际商事仲裁市场竞争机制下的国际商事仲裁司法审查问题,论证了司法对仲裁的支持是许多国家增强本国仲裁国际竞争力的重要手段;最后,论证了中国仲裁司法审查实践对增强中国仲裁国际竞争力的积极影响,并提出了人民法院进一步改进仲裁司法审查实践以强化对仲裁的支持的四项建议,包括以能动司法理念指导仲裁司法审查实践;公开宣示支持仲裁的司法政策;在现行立法框架下继续丰富支持仲裁的司法实践;推动中国仲裁司法审查制度的立法改革。
