摘要
形式与质料是生命伦理学知情同意原则存在的基本向度。普遍性的程序是知情同意形式层面的表现,行善的道德承诺是知情同意质料价值的彰显。在生命伦理实践中,知情同意出现了形式与质料的断裂:一方面,强调知情的形式或同意的程序性催生知情同意的形式主义;另一方面,强调知情同意的行善价值导致质料对形式的抛弃。只有完整地把握知情同意的合理内核,才能修复其质料与形式的割裂现象,进而实现二者的内在统一。
Form and material are basic dimensions of informed consent in bioethics. The form is universal procedure, while the mate- rial value is the moral promise of beneficence. In the practice of bioethics, there are rapture between form and material of informed consent. On one side ~ to stress the form of information or the program of consent leads to the formalism of informed consent. On the oth- er side, paying emphasis on the beneficial value brings about forsaking the form. The abnormal phenomena may not wholly master the reasonable core of informed consent; therefore, to achieve the intrinsic uniform of informed consent, it＇ s a must to repair the split be- twcen material and form.
