摘要
医疗技术鉴定是医疗事故纠纷处理的关键,只有设计出科学合理的鉴定制度才能做出公正、公平的鉴定结论。从民事委托-代理制度的视角,对医学会的鉴定行为进行法律分析,对医学会做为代理人的鉴定行为提出质疑,并提出了完善鉴定制度的建议。
Medical appraisal plays a key role in dealing with medical disputes. Only by scientific and rational appraisal sys- tem can a just and fair conclusion be obtained. The appraisal behavior of medical association was analyzed in view of entrust and agent. From which the appraisal behavior of medical association as an agent was questioned. Based on which, some countermeas- ures to perfect the appraisal system were put forward.
