摘要
全球气候变暖背景下绿色专利的跨国转移是国际减排工作得以全面落实的关键,有助于实现绿色清洁技术运用的全球化。绿色专利与一般专利相比更倾向于通过非市场机制进行跨国转移。从驱动和制约两个方面对绿色专利跨国转移的动力机制进行分析后,从绿色气候基金效用的发挥、国际法律的完善和绿色伙伴关系的建立三个方面提出了推进绿色专利跨国转移的政策保障建议。
Under the background of global warming, transnational transfer of green patent is the key to implement international emission reduction and catalyzer for globalization of clean technology. Compared with other patents, green patent is apt for achieving transnational transfer through non-market mechanisms. From two aspects of motivation and restriction, this paper elaborated the dynamic mechanism of the transnational transfer of green patent, and put forward some advices of institutional guarantee that can induce transnational transfer of green patent through exertion of Green Climate Fund, improvement of international law and establishment of green partnership.
