摘要
国籍原则是"中心"仲裁机制和外交保护制度的共有原则,但其具体内容和要求存在重大差异。《外交保护条款草案》第17条在投资者外交保护事项上似乎确立了"中心"仲裁机制优先适用的特别法地位。然而,由于《关于解决一国和他国国民之间投资争端公约》第27(1)条建立在投资者始终拥有单一国籍的假定前提之下,在多重国籍投资者以及投资者国籍发生变更的情况下,此类投资者的外交保护便会面临众多困境;同时,坚持ICSID仲裁机制的优先性将对外交保护制度形成严重冲击。
The principle of nationality is shared by ICSID arbitration mechanism and the regime for diplomatic protection; however, there are lots of major conflicts on the contents and requirements between both systems. It seems that article 17 of Draft articles on Diplomatic Protection establishes the priority of ICSID arbitration mechanism over diplomatic protection regime of foreign investors. Article 27 (1)of ICSID Convention is constructed on the premise that foreign investors constantly possess single nationality, those investors with multi-nationalities or whose nationality has been changed will face many morasses. Meanwhile, the priority of ICSID arbitration mechanism will seriously undermine the system of diplomatic protection.
