摘要
语言是法律及其实践的纽带,法律法规及重要的法律事实都由语言传递。复杂的法律术语、模糊的法律语言、法律语言在交流中的变异等因素成为法律语言交流和沟通中的干扰,正确面对无法克服的干扰,对可以克服的干扰需要语义学、法哲学和司法人员的法律道德素养的综合性的合力。
Language is the link of law and legal practice,as important legal facts as well as legal rules and regulations are all conveyed through language.However,factors like complicated legal terms,ambiguous legal language and variation of legal language in communication have actually caused interference to the exchange of ideas and communication in legal language.This article holds that we should correctly face the impossible-to-eliminate interference and that,to deal with the possible-to-eliminate interference,we need comprehensive and integrated force of semantics,legal philosophy and the legal morality of judicial functionaries.
