摘要
前很多国家都已建立生产者责任延伸制度,该制度是循环经济的一项基本制度。但是国内外对"谁是生产者"存在很大争议,争议的焦点在于产品原材料生产者、产品零部件生产者等间接生产者是否也属于该制度生产者的范畴。本文分析了目前国内外关于生产者的界定,阐述了将间接生产者纳入生产者范围的必要性及理论基础,建议将生产者责任延伸制度的生产者扩张为直接生产者和间接生产者,并合理分担延伸责任。所以,明确谁是生产者,将更加有利于生产者延伸责任的承担。
At present,many countries have set up Extended Producer Responsibility System which is the basic system in Circular Economy.But there is highly controversial about ＂ Who is the producer＂at home and abroad.The focus of the dispute is that if indirect producers,such as raw material producers and parts producer of product,also belongs to the producers？ This paper analyzes the current domestic and overseas definition of producer.Describes the Necessity and theoretical foundation that add the indirect producer to the range of producers.Recommended that expand the producers for direct producers and indirect producers,and share the extended responsibility reasonably between direct and indirect producer.Therefore,clear ＂who is the producer＂will be more conducive to undertake producer＇s extended responsibility.
