摘要
中国古代没有"物权"概念,"物权"概念来自近代西方法学。但在中国古代,无论在观念上、事实上还是在相应的法律制度上,"物权"都是存在的,两宋也不例外。从法制史的角度,以土地物权为视角对两宋土地关系的法律特征进行了探讨。
Ancient China did not ＂property＂concept,＂Property＂ from the modern Western legal concepts.But in ancient China,both in concept,in fact or in the corresponding legal system,＂Property＂are there,Song is no exception.From the perspective of legal history,the perspective of land property relations on the characteristics of the Song property were discussed.
