摘要
集体合同争议是劳动争议的一种类型。目前,集体合同争议解决机制存在着不少缺陷,使我国集体合同争议的处理效果很不理想,造成人力、物力和司法资源的巨大浪费。应当从建立平等协商制度,完善三方调解制度,改革仲裁裁决制度,设立专门的劳动争议审判庭等方面加以完善。
Dispute over a collective contract is a kind of labor disputes. However, it makes our national collective contract dispute resolution effect encounter severe challenges on account of lots of disadvantages in collective contract dispute processing mechanism, which leads to the waste of man power and material and judicial resources. It is necessary to solve these problems to make the collective contract dispute processing mechanism of our country sound develop, such as establishing equal consultation system, improving the rules of consultative procedure, setting up three-party mediation mechanisms, reforming arbitral award institution, founding special labor dispute judicial bench.
