摘要
行政犯罪客观要件是指,基于刑法的规定,行为人因违反行政法规并严重危害派生生活秩序而构成犯罪所必须具备的行为及其他客观事实特征。严重危害派生生活秩序是判断行为是否属于行政犯罪行为的关键。在行政犯罪客观要件诸要素中,结果要素占有重要地位。行政犯罪行为的结果及其认定均具有复杂性。
According to the criminal law＇s provision, the objective aspects of administrative crime include the behaviors and other objective facts that must be satisfied to constitute the crime of violating the administrative law and jeopardizing the secondary order of life severely. Jeopardizing the secondary order of life severely is crucial to judge the behavior of administrative crime. In the factors of the objective aspects of administrative crime, the consequence is important. It is complicated to identify the consequence of administrative crime.
