摘要
依据经济学分析法学的"正义-效率"观,冲突法的效率价值可以作为正义的实现维度。然而,这种联系的实现可能受到冲突正义的要求以及作为实质正义含义的其他价值目标的约束。在法律选择阶段与准据法适用阶段,与冲突正义和实质正义对应的效率实现维度表现出明显的二重性特征。全球化时代为冲突法的效率标准注入了新的内容,在这一新的背景下,效率成为正义的实现维度所需的条件得以成就。
To analyze the legal concept of ＂justice and efficiency＂ with economic analytical method,the value of efficiency in Conflict of Laws can help realize justice.However,the realization of this connection is influenced by the justice in a conflict and restricted by other value objects included in the connotation of substance justice.In the stage of choice of law and application of it,the realization of efficiency corresponded with justice of Conflict of Laws and that of substance shows dual features.Globalization provides new contents for the efficiency standard of Conflict of Laws and in this context,efficiency provides conditions for the realization of justice.
