摘要
教师均衡配置是义务教育均衡发展的瓶颈。我国教育立法的局限性与以效率为导向的基础教育政策导致义务教育的非均衡发展。《教师法》对于教师作为"履行教育教学职责专业人员"的法律地位和以此为基点设计的教师资格制度、职务制度、聘任制度,不能从根本上遏制当前义务教育教师非均衡发展的态势。惟有将义务教育教师定位为国家公务员,确立政府与教师的行政法律关系,各级政府所作的教师均衡配置的行政行为才有法律依据。
Equilibristic arrangement of teachers is the bottle-neck of balanced development of compulsory education. The limitation of educational legislation in our country and efficiency-guiding policy for elementary education has led to a non-balanced development of compulsory education. However, the ＂Teachers＇ Statute＂ provides the teacher as ＂a professional implementing educational and teaching responsibility＂, based on which it establishes the system of the teacher＇ s qualifications, that of the teacher＇ s positions, and that of the teacher＇ s employment. This can utterly cleanse the current situation of non-balanced development of compulsory education. Thus the executive conduct of governments as different levels for equilibristic arrangement of teachers can find its legal basis only by identifying teachers of compulsory education as civil workers and determining the executive and legal relationship between teachers and government.
