摘要
宪法义务的产生是源于人们对于幸福的承诺,即个人为了实现自己的幸福而在日常生活中采取一定的合作手段,并把这种建立在经验基础上的维护社群存续的合作习惯于建立国家之后以宪法契约的形式制度化。国家起源、人性论、和谐社会、自由主义等思想构成了宪法义务的理论基础,这些理论内在的预示了宪法义务的发展趋势。
Constitutional obligations are derived from the commitment of happiness. Citizens must take means of cooperation that maintain the existence of the nation in order to achieve their own personal happiness. The origin of country, the theory of human nature, a harmonious society, liberal thought and so on constitute the theoretical basis of constitutional obligations. These theories inherently indicate the development trend of constitutional obligations.
